User’s Acknowledgment and Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and B&D Aesthetics, LLC dba Sculptd, LLC ("Sculptd," "we," "our," or "us"), located at 15965 Drake St NW, Andover, MN 55304. These Terms govern your access to and use of all Sculptd services, including but not limited to non-invasive body contouring, testosterone replacement therapy ("TRT"), medical weight management, hormone optimization, and vitality or longevity-based medication programs (collectively, the "Services") via our website, https://getsculptd.com (the "Website").

1. NO MEDICAL EMERGENCIES Sculptd does not provide emergency medical services. If you are experiencing a medical emergency, call 911 or visit your nearest emergency facility immediately.

2. NON-CLINICAL NATURE OF CERTAIN SERVICES Sculptd offers both medical and non-medical wellness services. Our aesthetic services, including non-invasive body contouring for fat reduction, muscle toning, and skin tightening, are cosmetic in nature and not intended to diagnose, treat, or cure any medical condition. Medical services are provided exclusively by independent licensed healthcare professionals through telehealth platforms.

3. ELIGIBILITY AND LOCATION Our Services are available to individuals aged 18 or older. Medical services are currently limited to Minnesota residents physically present in the state at the time of telehealth consultation. Sculptd reserves the right to modify service eligibility at its discretion.

4. TELEHEALTH AND MEDICAL OVERSIGHT Telehealth consultations are conducted by independent licensed providers operating under medical oversight. Providers exercise independent judgment and may approve, deny, or modify your treatment plan accordingly. Sculptd does not control clinical decisions.

5. LABORATORY SERVICES We coordinate laboratory diagnostics through third-party providers. These providers handle all aspects of lab services, including sample collection and analysis. Failure to complete required labs within designated timeframes may delay or restrict access to certain treatments.

6. PRESCRIPTION MEDICATION FULFILLMENT Prescriptions are issued solely at the discretion of your licensed provider and fulfilled by licensed third-party pharmacies. Some prescribed therapies may involve controlled substances that require ongoing clinical oversight. Fulfillment is contingent on successful completion of all required steps, including labs, reviews, and virtual consultations.

7. NON-INVASIVE BODY CONTOURING SERVICES Sculptd offers cosmetic body contouring sessions using advanced non-invasive technology. These services are not medical in nature and are intended solely for aesthetic purposes. Individual results may vary. While most clients report visible improvement in target areas, we do not guarantee any specific outcomes.

Clients are required to complete and sign appropriate service-specific consent and waiver forms prior to receiving treatment. Contraindications (e.g., pregnancy, pacemakers, metal implants) are communicated in advance and may disqualify certain individuals from treatment.

We reserve the right to decline services at our discretion. Refunds for body contouring packages may be considered in rare cases where services have not yet been rendered. However, all sales are generally considered final, and partial refunds may be issued only under exceptional circumstances, as determined solely by Sculptd.

Clients may consent to before-and-after photography for treatment tracking or promotional purposes. Photos are only taken with explicit client approval and never used without signed consent.

8. PAYMENT TERMS AND REFUND POLICY All Sculptd services are cash-pay only. We do not accept or process insurance claims. You agree to pay all fees in advance. Package pricing may include:

Laboratory testing

Virtual consultations

Medical review

Medication or supplement planning

Aesthetic treatment sessions

Refunds:

Non-refundable: lab tests ($75), consultations ($50), and services already rendered

Prescriptions: once processed, no refunds are available

Body contouring: partial refunds may be issued for unused sessions only under exceptional, case-by-case circumstances

9. SUBSCRIPTIONS AND BILLING Some services are billed on a recurring basis (monthly, quarterly, or annually). By enrolling, you authorize automated billing to your payment method. Cancellations require a 30-day written notice before the next billing cycle. Failure to complete required appointments does not cancel billing.

10. COMMUNICATION CONSENT By using our Services, you consent to receive necessary communications via SMS, email, or phone regarding your appointments, care plan, and account activity. These messages comply with HIPAA and relevant privacy regulations. You may opt out of marketing messages.

11. NO INSURANCE ACCEPTANCE Sculptd does not bill or interact with health insurance carriers or federal programs like Medicare/Medicaid. You agree not to submit any third-party reimbursement claims.

12. SERVICE MODIFICATIONS We may modify, suspend, or terminate any service offering, pricing, or provider availability without prior notice. Continued use of Services constitutes acceptance of updated Terms.

13. WARRANTY DISCLAIMER All Services are provided “as is” without warranties of any kind. Sculptd disclaims any and all express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service.

14. LIMITATION OF LIABILITY Sculptd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability shall not exceed the amount you paid in the 12 months preceding your claim.

15. DISPUTE RESOLUTION AND ARBITRATION All disputes are governed by Minnesota law. You agree to resolve disputes via binding individual arbitration administered by the American Arbitration Association. Class actions and jury trials are expressly waived. Arbitration will take place in Minnesota unless otherwise mutually agreed. You may opt out of arbitration by written notice within 30 days of accepting these Terms.

16. FORCE MAJEURE We are not liable for service disruptions due to events beyond our control, including natural disasters, supply shortages, war, civil unrest, regulatory changes, or technology outages.

17. INDEMNIFICATION You agree to indemnify and hold harmless Sculptd, its affiliates, officers, employees, medical professionals, and service partners against all claims, damages, or losses arising from your use of Services or violation of these Terms.

18. SEVERABILITY AND WAIVER If any provision is found unenforceable, the remaining Terms remain valid. Failure to enforce any provision is not a waiver of that right.

19. ENTIRE AGREEMENT These Terms represent the full agreement between you and Sculptd and supersede all prior communications.

20. MODIFICATIONS TO TERMS We may update these Terms periodically. Updated versions will be posted on our website. Continued use of Services indicates your acceptance of changes.
